Brothers remanded on gun charge

Tuesday, February 21, 2012

MANDEVILLE, Manchester- Two men from the South Manchester area were remanded in custody last Wednesday when they appeared in the Mandeville Resident Magistrate’s court to answer to charges of having a homemade firearm in their possession.

They will return to court on Wednesday February 29.

The accused Cewayne Morgan, 21, and Lovllyod Bailey, 23, who told Resident Magistrate’s Desrie Alleyne that they are half-brothers were alledged to have a homemade firearm on a chair in a one bedroom dwelling where they occupied when the police knocked, identified themselves and entered.

The men pleaded not guilty to the charge.

Attorney-at-law Norman Manley, who is representing the accused men told RM Alleyne that the account by the police 'lacks credibility' as the men could not have had the weapon in open view knowing the police was at the door.

Morgan had a previous conviction of having one ounce of ganja in his possession which was mentioned by the Resident Magistrate.

Manley argued that the ganja possession conviction was not proof that Morgan was a danger to society and on that basis he was making an application for bail for both of his clients.

The RM reminded the attorney that possession of a firearm was a serious offense.

Manley said that he will have character witnesses for his clients at the next court date when he will continue to make application for bail.

The firearm has since been taken for ballistics investigations.
