‘Ignore environmental laws at your own peril’

Krishna Desai, attorney-at-law at Myers, Fletcher & Gordon (MF&G), takes command during his presentation on “Environmental Law and the liability of company directors, CEOs, and other officers for criminal offences”, at last week’s Wednesday Morning Seminar, hosted by MF&G and the Jamaica Chamber of Commerce.

To reduce exposure to potentially costly offences, Desai advised that businesses must keep current with environmental laws, including those related to physical development, certain uses of the beach, possession of certain wild life and discharges of pollution to the environment. Though some fines may be low, he urged company executives to be alert to the potential exposure faced for imprisonment of representatives of companies, given that environmental offences are crimes against the state and the offences are usually strict liability offences.
